Terms of Service

These Terms of Service ("Terms") apply to this website (hyperspaceconnect.com), the Hyperspace sign-in service, the applications Hyperspace Inc. ("Hyperspace", "we", "us") hosts for its clients, and the Hyperspace Account Security text message program (together, the "Services"). By using the Services you agree to these Terms. Where a client has a separate written agreement with Hyperspace, that agreement governs the client's relationship with us and takes precedence over these Terms where they conflict.

1. The Services

Hyperspace builds custom software and system integrations and hosts business applications for its clients. Access to hosted applications is limited to users a client authorizes. Clients are responsible for deciding who has access and for the accuracy and lawfulness of the data they and their users enter.

2. Accounts and sign-in

• Each user must use their own account and keep their password and one-time codes confidential.
• Sign-in requires your password and a one-time code sent to your email.
• Tell your administrator or us right away if you suspect unauthorized use of your account.
• We may suspend or disable access to protect the security of the Services, or when a client asks us to.

3. Acceptable use

You agree not to:

• use the Services to break the law or infringe the rights of others;
• send spam or unsolicited messages through the Services;
• attempt to access accounts, data or systems you are not authorized to access;
• interfere with, probe or overload the Services, or bypass their security measures.

4. Text message program terms

Program name: Hyperspace Account Security.

Program description: Hyperspace Account Security sends password reset codes by text message to users of Hyperspace-hosted applications who opt in, so they can reset a forgotten password securely. It also sends one confirmation when a user enrolls. No marketing or promotional messages are sent.

• How you opt in: after signing in, you may add your own mobile number on the Add your mobile number page and check the consent box. See our SMS Opt-In page.
• Consent is not a condition of purchase or service. If you don't opt in, your administrator or Hyperspace support can reset your password.
• Message frequency varies. Messages are sent only when you request a password reset, plus one enrollment confirmation.
• Message and data rates may apply. Contact your wireless carrier for details about your plan.
• To cancel, reply STOP to any message. You will receive one confirmation and no further messages. Reply START to resubscribe.
• For help, reply HELP, call 818-957-8500 or email contact@hyperspacehq.com.
• Carriers are not liable for delayed or undelivered messages.
• You must be the account holder of the mobile number you provide, or have the account holder's permission to enroll it.
• How we handle your mobile number and consent is described in our Privacy Policy.

5. Client data and intellectual property

Clients own the business data in their applications. Hyperspace owns its software, tools and know-how, except as a client's written agreement provides otherwise. Nothing in these Terms transfers ownership of either party's intellectual property.

6. Fees

Fees for development, integration and hosting are set out in each client's separate agreement or order with Hyperspace. Users are not charged by Hyperspace for using hosted applications.

7. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the extent permitted by law, Hyperspace will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Hyperspace's total liability for any claim relating to the Services is limited to the amounts the client paid Hyperspace for the Services in the 12 months before the claim arose.

9. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date. Continued use of the Services after a change means you accept the updated Terms.
